All California notaries are required to maintain a journal of notarial acts with bound and numbered pages. The Notary Public journal must be sequential and must include all notarial acts performed by the certified notary public.
Time and dates of each and every notary public action. The type of notarial act (i.e., acknowledgment, jurat, etc. Type of document to be notarized, i.e., Deed of Trust, Affidavit, etc. An indication as to how the signer was identified i.e., type of identification document or by credible witness along with the identification number, issuing agency, and expiration date. The fee charged (if no fee is charged, write 0 or no fee The signature of each person whose signature is being notarized. The right finger print of the person signing the documents is also required(if available).
Proper thumb printing is required to be placed in a Notary Public journal at all times.There are circumstances in that vary when thumb printing such as:
If the document being notarized is a deed, a quitclaim deed, a deed of trust affecting real estate, or a power of attorney it is required that the signer place his or her right thumbprint in the journal. An available thumbprint should be used if the right thumb print is not available for thumb printing.
If the signer is physically unable to provide a thumbprint or any fingerprint, this must be noted in the Notary Public journal with an explanation of the physical condition which keeps the signer from leaving such print i.e. broken hand in cast, burns, or other physical ailment.
A journal for a notary public should have an area for additional information that may be necessary for various notary jobs. Taking notes is important in case some discretion occurs in the future and referencing journal entries will help clear up matters. More often than not, unusual circumstances or other instances should be noted in the notary public journals.
A notary public journal or ledger should always be kept in a secure location such as a lock box, safe or other fire proof area. If the sequential journal is stolen, lost, misplaced, destroyed, damaged, or otherwise rendered unusable, the Notary Public immediately must notify the Secretary of State by certified or registered mail. The notification must include the periods of journal entries, the notary public commission number, the commission expiration date, and, when applicable, a photocopy of the police report that lists the journal.
Additionally, it cannot be stated any clearer that the Notary Public journal is very important and should be kept up to date with journal entries.
